The New Brunswick Standard Form of Lease

What it is
The Standard Form of Lease is the prescribed residential lease for New Brunswick. Every landlord must use it, and you cannot draft your own from scratch. The form sets out the parties, the unit, the term, the rent, what is included, and the security deposit.
When to use it
- Whenever you start a residential tenancy in New Brunswick, for a fixed term or month to month.
- When you renew or change a tenancy and want the terms in writing.
The rule in New Brunswick
The lease cannot be altered, and any deletion from it is void. You can add terms in the blank sections as long as they do not take away a right under the Residential Tenancies Act. The landlord and tenant each keep a signed original, so two duplicate copies are signed.
The deposit on the lease can be at most one month's rent, and it is held by Service New Brunswick, not the landlord.
